Storm drains can be treacherous to walk on, especially if they’ve been painted or decorated in any way. One Florida man learned exactly this in May 2015 when he slipped on a storm drain mural while visiting Springfield, Missouri.
Michael Trask, a resident of Martin County, Florida, was visiting Springfield, Missouri when he slipped on a painted storm drain outside the Greene County Justice Center on Booneville Avenue on May 20, 2015. Trask sustained a knee injury from the fall and although the city’s insurance covered the incident, Trask sought additional compensation for pain, suffering, and other damages.
In June 2017, the city of Springfield reached a settlement with Trask in the amount of $200,000. The city admitted that the storm drain mural had fallen behind its regular maintenance schedule, which is designed to reseal murals to prevent them becoming slippery when wet. Although too late for Trask, the city now suggests that it maintains its storm drains on a very tight schedule. Estimates suggest there are approximately 40 storm drain murals that were painted between 2011 and 2014, however, some of them have been removed due to becoming hazards after being damaged by time, weather, and construction.
