Carver Theaters, or the Historic Carver Theater in New Orleans, Louisiana, is under fire after a patron slipped on an unclean floor. As the person exited the theater, she slipped, fell and became injured.
On January 18, 2017, Carolyn Schexnayder filed a lawsuit in the Orleans Parish District Court against Carver Theaters, LLC and Nationwide Insurance Co. The lawsuit states that on January 15, 2016, Schexnayder was a theater patron and slipped and fell on an unknown substance on the floor as she left the establishment.
The lawsuit alleges negligence. It states that the floor was not cleaned, and it states that the theater is at fault for the fall. The fault is due to negligence in keeping the facility safe for guests. The negligence also stems from a failure to warn of hazardous conditions that existed within the building.
Damages remain unspecified. However, the lawsuit states that the plaintiff is suing Carver Theaters, LLC for all reasonable damages and appropriate financial relief. This includes court costs and attorneys fees. The specific injuries suffered by the plaintiff at the time of the fall are also unclear. However, it’s likely the plaintiff suffered injuries and has medical bills and lost wages to be recovered in the suit.
What to Do If You’re a Victim of a Slip and Fall
A slip and fall can happen anywhere and at any time. Under premises liability laws, public establishments — like movie theaters, grocery stores, and gas stations — owe a duty of care to their patrons to provide a safe and hazard free environment. They also must warn patrons if any hazards do exist. However, when a property owner fails to meet their duty of care and an injury occurs, the owner of the establishment may be held legally responsible for any injuries and damages.
